This Fair Usage Policy (FUP) is strictly enforced platform-wide to prevent misuse, protect our infrastructure, and maintain compliance with Indian and international regulations.
By subscribing to any SaminusAI plan or using any of our platform modules, you expressly agree to be bound by this Fair Usage Policy in its entirety.
1. PERMITTED USE
SaminusAI services are designed exclusively for genuine, lawful business communication and automation. Permitted use includes:
WhatsApp Business API & Inbox
Sending transactional alerts, service notifications, appointment reminders, and support messages to customers who have opted in via valid consent.
AI Chatbot Builder
Building and deploying intelligent customer-facing chatbots for legitimate business enquiries, lead qualification, FAQ automation, and support flows.
Forensic QR Engine
Generating dynamic and forensic QR codes for genuine business purposes — menus, review routing, vehicle registration, NFC linking, and branded campaigns.
Booking QR & Manager
Managing real, legitimate customer appointments and reservations for verified business establishments such as clinics, salons, restaurants, and service providers.
Agency Prospector
Using the prospecting tool for verified business outreach to legally identified potential clients for your own agency services — in compliance with applicable telemarketing and DND regulations.
Landing Page Builder
Creating authentic, accurate business landing pages for real products and services that your business actually offers to genuine customers.
Review QR & Reputation Tools
Routing satisfied customers organically to your Google Business Profile or other review platforms — strictly without incentivization, coercion, or manipulation.
Vehicle QR & Omni Node
Deploying Vehicle QR for legitimate fleet management and Omni Node for lawful multi-channel communication under verified business operations.
2. PROHIBITED ACTIVITIES — PLATFORM-WIDE ENFORCEMENT
ZERO TOLERANCE NOTICE: The following activities are strictly and categorically prohibited across all SaminusAI modules. Any violation will result in immediate, permanent account termination without notice or refund, and may result in criminal reporting to the appropriate authorities.
2.1 Prohibited WhatsApp & Messaging Conduct
- Sending Unsolicited Commercial Communication (UCC) in violation of TRAI's TCCCPR, 2018
- Broadcasting promotional or marketing messages to individuals who have not explicitly opted in
- Messaging subscribers registered on the National Do Not Disturb (DND) registry without valid prior consent
- Sending bulk spam messages, chain messages, or mass unsolicited alerts
- Automated bulk messaging without valid, verifiable end-user opt-in records
- Impersonating government agencies, banks, healthcare authorities, or any other organization in messaging campaigns
- Sending phishing messages, fake loan offers, fraudulent investment schemes, or OTP harvesting content
- Messaging to promote religious, political, or ideological campaigns or parties
2.2 Prohibited Chatbot Usage
- Using the AI Chatbot Builder to simulate medical, legal, or financial advice without qualified professionals
- Training the chatbot on content that is defamatory, obscene, sexually explicit, or incites communal violence
- Deploying chatbots on external platforms to scrape personal data from end-users without explicit consent
- Using chatbot flows to deceive or manipulate users into making unauthorized purchases or data disclosures
2.3 Prohibited QR & Landing Page Usage
- Generating QR codes that redirect to phishing sites, malware downloads, or deceptive content
- Creating landing pages to collect personal or financial data fraudulently
- Using the Review QR tool to solicit fake, incentivized, or manipulated reviews on Google or any third-party platform
- Deploying Vehicle QR for unauthorized tracking, stalking, or profiling of individuals
- Hosting adult, pornographic, gambling, illegal narcotics, or piracy-related content via landing pages or QR redirects
2.4 Prohibited Agency Prospector & Business Intelligence Usage
- Using the Agency Prospector for bulk harassment, intimidation, or aggressive unsolicited cold-calling campaigns
- Selling, renting, or distributing scraped business data to third parties in violation of data protection laws
- Using intelligence data to target individuals for personal harassment or discrimination
2.5 Prohibited Platform-Level Activities
- Outsourced Call Centre operations or Public Phone Booth (PCO) activities using SaminusAI infrastructure
- Robo-calling, automated voice blasting, or automated bulk SMS campaigns without TRAI approval
- DDoS attacks, SQL injection, rate-limit bypass, or any unauthorized penetration testing of the platform
- Reverse-engineering, decompiling, or scraping SaminusAI's backend APIs, AI models, or proprietary algorithms
- Sharing account credentials commercially or sub-licensing access beyond subscribed limits
- Manipulating platform analytics, fake scan simulation, or artificial traffic generation
- Using the platform for any activity involving money laundering, hawala transactions, or financial fraud
- Exploiting the Wallet/Credits system via fraudulent chargebacks, payment reversals, or coupon abuse
3. CONSEQUENCES OF VIOLATION
Immediate Action Without Notice
Upon detection of any violation of this Fair Usage Policy, SaminusAI will immediately block all services associated with the violating account without prior notice, without any service credits, and without any refund of subscription fees, wallet balance, or any other amounts paid. This action is final and non-negotiable.

Legal Disclosure Notice: In cases of illegal or unlawful activities, SaminusAI (Saminus Private Limited) reserves the unconditional right to disclose all relevant user information — including registered name, mobile number, email, IP logs, payment records, transaction history, and all platform activity data — to appropriate law enforcement authorities, CERT-In, TRAI, DOT, or any statutory body, without requiring user consent, as mandated under the Information Technology Act, 2000 and applicable Indian law.
4. HOW WE DETECT MISUSE — AI-POWERED MONITORING
SaminusAI deploys an advanced, proprietary AI-based Usage Pattern Recognition Engine that operates 24×7 across all platform modules. This system:
Behavioural Analytics
Monitors messaging velocity, contact patterns, template usage frequency, and chatbot interaction anomalies in real time.
Network & IP Intelligence
Detects VPN abuse, datacenter IP proxies, unusual geographic access patterns, and multiple account creation from single identifiers.
Content Scanning
AI scans all chatbot training data, landing page content, QR redirect URLs, and message templates for policy violations and harmful content signals.
Upon flagging by the AI system, accounts are immediately and automatically suspended pending human review. Following validation of confirmed misuse, the account is permanently blocked. No refund is offered under any circumstances in such cases.
5. MANDATORY ANTI-SPAM & MISUSE DECLARATION
Mandatory Activation Requirement
Anti-Spam and Misuse Declaration is a mandatory step during the activation of every SaminusAI account. By completing the account activation process, you confirm that you have read, understood, and unconditionally agree to comply with this Fair Usage Policy in its entirety. Activation without completing this declaration is not permitted, and any account found to have bypassed this step will be immediately terminated.
6. WHATSAPP BUSINESS API — SPECIFIC FAIR USAGE RULES
As an official WhatsApp Cloud API Solution Provider operating under Meta's WhatsApp Business API ecosystem and platform policies, SaminusAI enforces the following WhatsApp-specific usage limits and conduct rules:
- All marketing and promotional messages must use pre-approved Meta message templates only. Sending unapproved template variants or attempting to bypass template screening is prohibited.
- Messaging limits are governed by your WABA (WhatsApp Business Account) tier, which is set by Meta. SaminusAI does not artificially inflate or override Meta-imposed rate limits.
- You must maintain an opt-in compliance rate above 95%. Accounts consistently showing high opt-out rates, delivery failures, or quality rating drops will be subject to review and may be suspended.
- Transactional message credits (MTUs / conversations) purchased or included in your plan are non-rollover, non-refundable, and subject to Meta's conversation-based pricing.
- SaminusAI reserves the right to pause or throttle your messaging throughput if your account is flagged by Meta's Quality Rating system, to protect your WABA from permanent Meta-level suspension.
7. REPORTING VIOLATIONS
If you witness or suspect any misuse of the SaminusAI platform by another user, or if you believe your account has been incorrectly flagged, please contact our compliance team immediately:

All disputes are subject to the exclusive jurisdiction of the competent courts of Hisar, Haryana, India.
